As uncomfortable as thinking about death is, failure to address the issue of what will happen after you are gone can have consequences that are even more unpleasant. Estate planning is not something people spend a lot of time on and are very often reluctant to even take the first step. But, If you wait too long to make your wishes known, your loved ones might find themselves embroiled in years’ worth of legal battles over the assets in your estate.

Taking steps while you’re healthy to avoid this situation is far easier than trying to sort out the mess after something has happened. That’s why, at a minimum, people should consult an experienced real estate attorney in Knoxville, TN, to have a thoughtful estate plan drawn in place before they are no longer able to make decisions for themselves.

This article will highlight the most common mistakes people make regarding estate planning in Knoxville, Tn.

Not Having an Estate Plan at all

Some individuals think that they do not need to create an estate plan because they don’t have many assets. This is a common misconception. Everyone has something they would like to leave behind for their loved ones or charities after they die.

When building an estate plan, there are numerous factors to consider, such as:

What will happen if you and your spouse die simultaneously?

Who will inherit your assets if you do not have children?

What will happen to your estate if you become incapacitated?

If you fail to plan and name someone to take care of these matters for you, the property will pass to the state of TN according to intestate succession laws. This could result in your assets being distributed to people you do not know or who might not have your best interests at heart.

Making these decisions ahead of time and avoiding potential complications for your loved ones after you die is possible when you create an estate plan with skilled attorneys in Knoxville, TN.

Not Updating your Estate Plan Regularly

Just because you created an estate plan a few years ago does not mean it is still up-to-date. You need to review your plan regularly and make changes as required. For example, if you get married or divorced, that will affect the plan. Likewise, if you add a beneficiary to your retirement benefits or insurance policies, that too should go into your estate planning documents.

If you do not make changes as needed, the chances are that people you want to exclude from benefiting under your plan may be included and vice versa. This will lead to unnecessary legal disputes. And could mean that your property gets stuck in probate court for months or even years, causing tremendous amounts of stress for your loved ones.

Failing to Discuss with Family

Individuals often do not discuss their plans with anyone other than their lawyers, doctors, and financial advisors. However, the people who will be most affected by your plan are your family members. They need to know what you want to be done if something happens to you so they can carry out your wishes without hesitation.

It is best to let them in on the details of your plan early on, rather than waiting until you are physically or mentally unable to make decisions. This will reassure them that they are doing the right thing and prevent them from feeling like they were disinherited.

Not Naming an Alternative Beneficiary

Most people provide for their spouses to receive a certain percentage of their property when they die. Often, however, the spouse dies before the other person does, and then all of the assets go to someone else instead.

To avoid this situation, you need to name an alternative beneficiary in the event that your primary choice is not available at the time of your death. This can be a friend or relative who you feel will take care of your property responsibly or even a charity.

Not Having a Backup Executor

An executor is a person who is responsible for making sure that your final wishes are carried out after you die. This includes:

Notifying your beneficiaries about their inheritance

Distributing your assets according to your will

Filing all necessary legal documents and tax returns.

If something happens to the executor, you need to provide a backup in your estate plan so that the process can continue without unnecessary delays. This should be someone who knows your wishes and is able to carry them out accordingly. It can be your spouse or other family members.

Not Thinking About your Child’s Future

Even if your child is not yet an adult, you should still consider the time when he or she will be ready to manage their own financial affairs. Several factors can influence this process, including whether your child goes to college and how financially independent they choose to be.

You may want to name a “custodian” to act on your child’s behalf until he or she turns 18. However, you should note that this person does not have complete control over the assets; instead, he or she simply manages them for the benefit of another individual.

You can also consider using a trust account to provide for your child’s future. This is an excellent way to pass on your assets and can help to ensure that they will be protected and properly managed. Since a legal document creates the trust, it also avoids probate and makes sure that your child’s inheritance remains private.

If you appoint someone to assist with your finances, make sure that they are capable of making smart decisions and not be swayed by emotion.

Forgetting about Power of Attorney

A power of attorney is a legal document that allows you to appoint someone else to make decisions for you if you are unable to do so yourself. For example, suppose you become incapacitated and can no longer manage your own financial affairs. In that case, the person you named in power of attorney has the authority to act on your behalf.

This is especially essential if you want to avoid having your assets go through the court system after you die. This process can take months or years, tying up your property and preventing it from being given to your beneficiaries in a timely manner.

Your power of attorney is also valuable when it comes to getting medical treatment for you in the circumstance that you are unable to make those decisions yourself. By appointing someone you trust, you can be sure that the best possible care will be given to you.

Forgetting about Long Term Care

People often view long-term care as a cost for their elderly parents to absorb. However, it is also a major source of expense for many families with children who are not self-sufficient adults. You could end up with a mess for your loved ones if you fail to consider this fact when drafting your estate plan.

Many people are unaware that they can include long-term care benefits in their retirement plans. This ensures that you have the funds to cover your own potential need for this type of treatment before it is too late. Otherwise, Medicaid may be your only option.

If you do not want to use your assets or other sources of retirement savings, consider buying long-term care insurance on your own. This will provide for your medical coverage when you are unable to pay for it yourself.

However you choose to handle this situation, do not forget that long-term care is a major expense many families face today and needs to be addressed in an estate plan. Without adequate protections in place, some people may go bankrupt trying to cover all of the costs.

Not Considering Taxes

Another biggest mistake people make when drafting their estate plan is not considering the tax implications. This could cause significant financial difficulties for your beneficiaries when you pass away.

For example, if you leave your home to your children and it is worth more than $500,000, they will have to pay estate taxes on it. This could reduce the inheritance they receive by as much as 40%.

You can avoid this issue by giving your home to a trust rather than your children. This will protect the inheritance from estate taxes and ensure that your loved ones receive the total value of your property.

Taxes are just one example of the many things that need to be considered when drafting an estate plan. By working with an experienced Knoxville real estate attorney, you can be sure that your plan will account for all of the potential tax implications. This will help to ensure that your loved ones receive the full value of your estate after you die.

Failing to Consult a Reliable Knoxville Real Estate Attorney

Many individuals use DIY forms online for their estate planning documents. However, the available forms may not be suitable for your specific situation since they are very basic in nature. In addition, the will and trust created using these online services often leave families with more questions than answers. Finally, some of these documents are also not considered valid by courts in TN, which can lead to costly legal disputes.

In contrast, a qualified Knoxville real estate attorney will thoroughly review your situation and provide you with expert advice for developing valid documents that meet all of your needs. This ensures that your intentions are honored after death and prevents unwanted problems from occurring.

Not Securing your Estate Plan

You may have hired the best attorney to draft a perfect thoughtful estate plan, but what if your beneficiary cannot find the will, trust, power of attorney, or other documents?

To avoid this problem, make sure to store your estate planning documents in a safe place that only the actual beneficiary will know about. If you want them to know where you plan to store your papers and get multiple copies of the key so they can access it quickly when needed. Just like you would have a fire-proof box for your important documents, you should also have a safe place for your estate planning papers.

Conclusion

Drafting an estate plan can be very complex and involves many separate documents. Making even one mistake can have severe consequences for your loved ones. By working with a trusted real estate attorney in TN, you can ensure that your plan is correctly executed and avoid many of the common mistakes people make when planning their estate.

Many parents prefer revising their estate plans after their children become adults. When an estate plan is being revised, it’s carefully designed for efficient transfer of the assets to the spouse (surviving) and then eventually to the adult children.

Unfortunately, the inheritance process doesn’t prevent a serious issue that no parents in the world wish for – fractured relationships between siblings or sibling animosity.

In this article, we are going to discuss two very important topics:

The causes of sibling animosity or family friction

3 easy steps to handle estate planning amid family friction

For Bonus: How to pick the right attorneys in Knoxville TN or the US

Without talking any single second of your time, let’s jump straight to our first topic.

Causes of Family Friction

The list of factors that cause sibling animosity or family friction, during the process of inheritance, is very long. Some of the major causes include – “lack of communication among siblings’. It causes distrust in how things are taken care of and being handled. Another major cause includes the failure to agree:

If and how the properties should be maintained and sold

On who will pay for the full and final expenses

These are some of the issues that you will encounter during the inheritance process. Now when you have a good idea of a few problems, you will at least be prepared to face the plethora of issues that might come your way in the near future.

Like many, you might also be looking for ways to prevent facing these problems. Right? We suggest you use the three-step process for estate planning, which we have shared below.

Read More: Why do you need to begin estate planning now?

Step #1 Work With a Reliable And Trustworthy Estate Attorney

Since it’s about your real estate, choosing your local attorney won’t be a good choice. You have to choose a specialized real-estate attorney who has worked in this industry for a good period of time. More specifically, go with the attorney who has handled lots of inheritance processes.

The easiest way to find a good real estate attorney Knoxville TN is by asking for referrals from your colleagues, friends, or acquaintances. Moreover, to get better referrals, take the help of people who are – public accountants, wealth managers, or financial advisors. These kinds of professionals, most of the time, have a history of working with retirees and will help you find the right estate attorney.

In the end, we will be sharing a list of expert tips, you can follow to choose the right estate attorney. Till then, keep on reading the next steps and prepare yourself to avoid family friction.

Step #2 Create an Overview of All The Finances

A well-created real estate plan can drastically reduce the issues associated with your overall estate planning. However, a well-prepared plan does nothing towards helping your beneficiaries find what and where you own. Creating a financial overview helps in simplifying the inheritance process for the executor.

In addition, it will also create a strong foundation for you and the executor to openly communicate with the next beneficiaries in order to decrease the skepticism. Believe us, when things are done behind closed doors, skepticism is obvious to generate – which can be eliminated from a financial overview. So here are the things that must be included in your inventory:

List of all the insurance policies, assets, and liabilities

Contact information of all the insurance, financial and legal professionals like your lawyers in Knoxville TN for example, with close relationships

Usernames and passwords of all the websites your beneficiaries might need access to in future

A legacy notice or letter that reflects how the non-financial items, that you don’t have to share with your children, will be treated

Step #3 Schedule a Meeting With Your family

The last and final step is to schedule a family meeting. You have to call a family meeting, only once the financial overview and estate plan have been created. The family meeting must ensure the presence of all the children who are going to inherit the assets.

Following are the list of some important areas, you should cover during this meeting:

The outlined basics of your real estate intentions

Make at least one trustworthy member of the family aware of the location where all the important documents are being stored

Share the details of your executor

Ensure all the siblings and family members know how important is transparency and communication in the inheritance process

Discuss all the non-financial items of your legacy, that you are imparting from your children and the reason behind the separation.

Make everyone understand your intentions to keep things equal and fair. And how you wish that the inheritance process keeps the family together instead of tearing them into pieces.

So these were the three steps you can follow to make your inheritance process free from sibling animosity. Now comes the most important part, you might be waiting for so long. Let’s share the best tips to follow when choosing a real estate planning attorney.

Tips to Choose an Ideal Real Estate Attorney

Always prioritize experience, when choosing an estate attorney. An experienced attorney will have taken care of many cases, just like yours, in the past. This will assure you that they will handle your case more professionally and efficiently than an un-experienced attorney.

Don’t forget about your budget, that’s the first thing you should prepare before starting your lookout for an attorney. Creating a budget will help you spend your time effectively, scrolling down through those attorneys you can actually afford.

Make sure to check the customer reviews and testimonials of the attorney you have shortlisted. Reading through the experience of other customers with an estate planning lawyer gives you an idea of whether you should become their client or not.

Solid, effective estate planning is one of the most important things you can accomplish when it comes to taking care of your loved ones. It’s an area of your life where you can’t afford to make errors, but the process can often seem so complicated that mistakes are bound to happen. If you’re in the process of setting up a {legacy plan} of your own, check out this list of common trust and will mistakes—and how you can avoid them!

Mistake #1: Not following through.

Great estate planning is anything but set-it-and-forget-it. Implement and then regularly update the plan. You should leave the estate planner’s office with a checklist of actions you need to take. (Then, follow the checklist!) Update and revise as needed. Like all plans, an estate plan isn’t fixed and unchangeable. It’s a continuing project that needs to be revised and fine-tuned over time. Plan on seeing your estate attorney at least every couple of years.

Mistake #2: Keeping your trust and will a secret.

BMO Wealth Management’s Estate Planning for Complex Family Dynamics report included a survey which found the following:

40% of parents never discussed their estate intentions with their children;

Only 28% of adults said they knew details of their parents’ estate plans;

40% of those whose parents passed away believed their parents’ estate plans were unfair; and

25% of married adults said only their spouses know the locations of their estate planning documents.

Inform and prepare your heirs. Make them aware of the general value of your estate as well as assets and liabilities, and a general outline of the plan. Communicate your intentions and wishes for handling the wealth—and if they aren’t adequately financially literate, there are actions you can take to help them gain financial experience and acumen (or alternatively, put the wealth in trusts so others can make the big decisions). When heirs aren’t prepared, wealth often disappears. It can be wasted through poor spending decisions, bad investments, neglect and fraud. Your heirs need to know how to manage and spend the wealth before receiving it.

Mistake #3: Not funding a living trust.

Trusts are set up to avoid probate and ensure assets are managed in cases of disability. But for those goals to be met, assets must be transferred to the trust. The deeds to the family home and other real estate must be put in the trust’s name. Automobiles must be registered with the trust as the owner. The same holds true for financial accounts and other assets. If those steps aren’t taken, the trust is empty; it owns no assets. All the assets are subject to probate.

Mistake #4: Not updating the plan, including powers of attorney.

Every estate plan should include powers of attorney. You need at least two, one for financial matters and one for medical care (often called an advance medical directive). You’re more likely to become disabled and need these documents before you need a trust and will as well as the rest of your estate plan. Unfortunately, many people don’t have either of these documents and others haven’t kept them up to date or given the details much thought. Be sure you have these documents and that they have been reviewed recently.

You should be in touch with your estate planner any time there’s a major life change in your family. This could include a birth, death, divorce, or marriage. Factors like changes in your net worth, the composition of your estate, job status and residence should also trigger a review of your plan. Of course, a change in your goals or in the law also means a meeting with your estate planner is in order. Are you looking to set up your estate plan in the Knoxville area?

Estate planning is the preparation of tasks to manage your assets in the event of your incapacitation or death. This involves making a plan in advance, naming the individuals or organizations you want to receive your assets and organizing their management and transfer. Today, we’re covering the basics of getting started with your own plans for the future.

Take stock of your assets, both tangible and intangible.

Tangible: Think things you can physically take possession of, like homes, vehicles, collectibles, land and other personal possessions.

Intangible: These might include bank accounts, insurance policies, ownership of a business, retirement plans, stocks, bonds and mutual funds.

Once you inventory all these items, you need to estimate their value. Outside valuations (like recent appraisals and financial statements) will be helpful here. When you don’t have outside valuations, value your items based on how you’d expect your heirs to value them. This way, you can help ensure your possessions are distributed equally.

Account for your family’s future needs.

Consider how to protect your estate’s assets and your family when you’re no longer around. This may include naming a guardian for your children, documenting your wishes for their care and ensuring you have adequate life insurance.

Establish your directives.

You’ll want to have a few essential documents on-hand—namely:

Durable power of attorney. This is a document that lets you appoint a trusted person, such as a family member, as your agent to make financial decisions on your behalf in the event that you are you are incapacitated or unable to do so for yourself.

Will. It provides written instructions for how you want to distribute any assets held in your name and lets you appoint a guardian for minor children. Your will also names an executor responsible for carrying out those instructions. If you do not have a will, state law determines how your assets are distributed.

Living will vs. health care proxy. A living will allows you to specify the type of future medical care and treatment you receive should you become incapacitated. A health care proxy grants another person the power to make those health decisions for you.

Revocable trust. This one’s (relatively) optional and can be created with the assistance of a living trust attorney. A revocable trust is a written document of instructions for how you want your assets handled after you die. You, as the grantor or creator of the trust, can amend or terminate it at any time.

Review your beneficiaries.

Make sure the right people are benefiting from your estate planning. Check your retirement and insurance accounts’ beneficiary designations; they can outweigh what’s listed in awhile. Don’t leave any beneficiary sections blanks and name contingent, or backup, beneficiaries just in case.

Be up-to-date on your state’s estate tax laws.

Some states have estate taxes and some have inheritance taxes. This is where an estate attorney is going to come in handy. It’s our job to keep abreast of the applicable laws and regulations, so you can rest assured all your i’s are dotted and t’s are crossed. This is especially true if you’re working with a large or complex estate with special child care concerns, business issues or nonfamilial heirs. It’s also the case if you have any doubts about the process at all. A qualified trust lawyer will ensure you’re on the proper estate planning path, especially if you live in a state with its own estate or inheritance taxes. Estate planning is often a way to minimize estate and inheritance taxes.

Plan to reassess regularly.

Life is always changing—your estate plan should be flexible, too! Revisit your legacy planning when your circumstances change: in cases of marriage, divorce, childbirth, loss of a loved one, or even getting or losing a job. It’s worth reassessing even if your circumstances haven’t changed to be sure it’s in line with federal and state estate planning law.

Every individual’s estate planning needs are different, and the processes and laws for estate planning vary by state, which is why it is important to consult with your estate attorney for advice regarding your specific situation. It can be an intimidating and complex endeavor, but it’s beyond worthwhile. Thankfully, you don’t have to do it alone. Estate planning attorneys—like the expert trust attorneys at Volunteer Law Firm—are a great asset in ensuring you’ve got a plan in place you can feel good about.

Co-parenting after divorce is not an easy task. Mostly, emotional imbalance and court issues create ruckus in parents’ lives. Ultimately, this affects children’s life and growth. In the child custody attorney joint custody arrangements can become a nightmare for your child if you fail to cooperate with the co-parent.

Studies and statistics show that children of divorced parents are more likely to experience:

Physical hardships and illnesses like asthma, speech impediments, and other issues.

Relationship and trust issues

They end up less pleasant compared to children of their age

Show less focus on studies and curriculum

So it is necessary to find expert solutions and guidance to safeguard your family’s future.

Co-parenting mistakes are common among separated parents. It takes time to adapt to the situation. But if you fail to identify and correct them, then you are making things worse for your children. If you feel like getting expert assistance, don’t hesitate! Reach out to Knoxville divorce attorney and find solutions.

6 Co-Parenting Mistakes You Must Avoid

Understanding the possible co-parenting mistakes and finding solutions to fix them are necessary to provide your child with a better childhood and future. Your personal issues and mood swings should not affect your child’s mental and physical health.

Here are 6 co-parenting mistakes divorced parents often make:

1. Trying to Become Child’s Favorite By Demeaning the Other

A child deserves the love and care of a father and mother. But parents’ separation always makes them devoid of togetherness. And when it comes to co-parenting after separation, parents always fail to understand the child’s emotional struggles and try to win the child’s confidence and child custody by blaming the other parent. This is one of the biggest mistakes parents commit out of anger and hatred for each other. Make sure you are not restricting your child from attaining the affection of both parents.

2. Easily Losing Temper & Shouting Unnecessarily

It’s true that divorce and separation can be stressful at times. But every parent should take care to keep their child out of court and personal issues. If you feel tension and anger towards your ex-partner, your child should not be at the receiving end. Most parents forget about their responsibility towards children and shower their anger towards poor children. This can ruin your child’s childhood and may turn him or her into an introvert.

3. Promoting Victim Mentality in Children

Showing sympathy, possessiveness, and extra care will bring a victim mentality in the child. Special treatment overwhelms your child with unnecessary emotions, and it makes them feel like they lack something big in life. Raise them like normal children and make them mature enough to respect both your decision to live individually.

4. Using Your Child As a Mediator

Your child is not a mediator. Often divorced parents use their child as a channel to pass information. This will destroy your child’s peace of mind and end up making your child feel neglected. Knowingly or unknowingly, children sometimes become tools in the hands of parents. Their mind is fragile and delicate. If you break it once, you will not be able to gain their trust back. So always be careful while communicating with them about separation.

5. Asking them to Take Sides

Asking your child to choose one of the parents is an act of cruelty. Often this happens out of anger and parents’ inability to co-operate with the ex-partner. You cannot ask your child to make a decision to satisfy your ego and personal issues. If you have an issue with your ex-partner, either you should try to compromise it, or else you should hire a Knoxville divorce lawyer to solve the issues or get guidance.

6. Imposing Unnecessary Strictness & Making it a Power Struggle

Mostly, co-parents tend to show strictness and stubbornness out of possessiveness and fear. But, this is not going to help your child grow disciplined. Instead, this will make them feel neglected and caged. In a rush to get constant control over the children, parents engage in a power struggle and forget the child’s mental and emotional health.

Solutions to Fix Common Parenting Issues

If you find things beyond your reach, it is always better to consult a divorce lawyer who can help you figure out your issues amicably. Fixing co-parenting issues are necessary to bring balance in your life and your child’s life.

Here are some primary tips you can try to practice in your daily life:

Show respect and stop Blaming the co-parent in front of children and always talk politely with each other, especially when you are around children.

Inconsistency in schedules and locations creates panic in children. Get ready to talk and plan a schedule with your ex-partner.

Understand what’s triggering you before you blame others. If it is anger or any other post-separation issue, consult a divorce lawyer to find a solution instead of worsening your relationship with your child.

Apologize if you are wrong. Never keep on justifying your mistakes to prove others wrong.

Seek the assistance of divorce lawyers in Knoxville if you don’t want to engage in a conversation with your ex-partner.

Dealing with your life after divorce can be troublesome in the initial days.

Family law and child custody is a sensitive and complex aspect in law that needs special attention as it can impact your child’s life and future. When it comes to custody-related issues, even the court tries to deal with them in the best possible way to safeguard the interest of children.

Many challenges can come your way while addressing a custody case. Hiring the best child custody attorney is crucial to make it comfortable for your child without affecting his/her psyche. Finding the best lawyers in Knoxville TN for child custody can simplify the challenges to help your child and family deal with the issue maturely and practically.

Types of issues that arise during child custody disputes

In most child custody cases, parents fail to come to a mutual agreement on certain crucial factors. Here are some common challenges you need to tackle while appearing for a child custody case without making your child insecure about your decision:

Relocation Issues in Child Custody Case

If one of the parents is planning to move out of the state, agreeing on long-distance parenting is necessary. If things are smooth between the parents and you both agree with the relocation, then things can be settled out of court with the help of a lawyer for child custody.

But what if you both have a different take on the relocation. Things are going to be difficult. You both end up arguing with each other. In such cases, to deal with the moving out issue, it is wise to leave it up to the court.

Court analyses the factors that are causing one among you to move out of the state. The court looks into:

The reason for relocation

The benefits of moving out, if it raises the child’s standard of living

Whether the child gets quality time with both parents

The court pronounces a decision only by considering the benefits and emotional stability of the child. But at the same time, you can raise co-parenting issues you may face after relocation through a child custody attorney.

It is always better to raise your objections through a mediator or family law attorney. Direct involvement will worsen your relationship with your ex-partner, making things difficult for your child.

Visitation and Child Support Issues

Visitation disruption is a common challenge faced by parents. Sometimes custodial parents fail to bring the child at the right time. If the custodial parent is breaching the visitation agreement, contact your family lawyer to discuss what you can do next. Try to settle it out of court with your lawyer by trying to communicate with your ex-partner.

Both parents need to be flexible on grounds of co-parenting. If the co-parent fails in providing child support, the ex-partner may disrupt visiting the child, or else if there are disagreements or disputes, the co-parent may fail to follow the court order.

Access to Information About the Child

A custodial parent is responsible for the physical health and taking care of other core decisions. But that doesn’t mean that the co-parent is reluctant to gain any crucial information about the child’s health, education, and other necessities. Co-parent has the right to access information about the child and play a significant role in upbringing the child through proper mediation.

The child has the right to get affection from both parents. Neither parent should restrict the child from loving and spending time with the other parent. Both parents should be flexible enough to prioritize the comfort of the child.

Bad Mouthing Other Parent

If parents have personal grudges and disagreements, it shouldn’t be reflected in the child’s life. In most cases, parents fight in front of the child and bad mouth each other creating confusion and aversion in the child.

Personal grudges and relationship issues should not be used as a tool to fill your child’s mind with hatred for other parents. This often happens in custody issues and split parenting. If you find it difficult to talk and find a solution. Get expert assistance from a family law attorney specializing in child custody.

Electronic Communication Issues

Communication issues are a common problem in a child custody case. If it is long-distance co-parenting, it becomes difficult for the other parent to catch up with the child’s well-being and maintain a good relationship. If you have a distorted relationship with your ex-spouse, things may become difficult. He/she can avoid picking up calls and replying to your messages.

Building clarity on communication and visitation is imperative for smooth and flexible co-parenting. If you have any objection or concern, you can seek the court’s assistance instead of embarrassing your child and worsening the situation.

Substance Issue in Child Custody Case

If one of the parents is a drug addict, the other parent has all the right to refrain the child from a toxic relationship. Drug or substance addiction can be raised in front of the court to get your child’s custody to confirm his/her safety, health, and development.

A parent should have a stable home environment to get custody of the child. Substance issue is a crucial factor that determines the child’s custody. The court looks into the drug consumption history of the parent and family members to safeguard the child from probable domestic violence and child abuse.

The court and legal sectors include various sections and non-criminal disputes. If you want to deal with property issues and legal rights, you must seek the assistance of a civil litigation attorney. Civil lawyers are attorneys who are specialized in legal rights and civil law. They help people to simplify the lawsuits and help them bring convincing evidence to attain justice in front of the law. To become a civil litigation lawyer, the person must achieve a law degree from the American Bar Association.

From filing a lawsuit to taking it to court, a civil lawyer assists you in the entire process. A civil attorney studies the entire case and helps you find whether the case is suited for court proceedings or if there is any loophole to settle it outside the court.

Some of the common types of civil cases include:

Property Debate

A property debate can include anything that causes harm to a person’s assets. Or else, it includes disputes between relatives or neighbors in matters of crossing the land boundary or seizing the shares or finance through fraudulence. In most cases, civil litigation lawyers try to solve the dispute outside the court through family settlement, partition, or amicable negotiations.

Contract Disputes

As the name suggests, contract disputes happen if allies or partners fail in keeping the contractual guidelines. It can be related to alimony issues, business agreements, or anything. The plaintiff can ask for compensation or any other legal remedies through the assistance of a civil attorney against the party who violated the obligation signed under a contract.

Torts

A Tort case mainly focuses on injuries, personal harm, or defects caused due to lack of safety, carelessness, or failure in showing commitment to the duty and regulations. It can be due to negligence, but a case will be filed against the person who inflicted injuries or harm.

A trot case is a broader area. It can include intentional tort, unintentional torts, or strict liability torts. Depending upon the nature and intensity of the trot case, civil lawyers help the plaintiff to get compensation or free medical assistance.

Class Action

A class-action case is a kind of lawsuit where a plea or complaint is raised on behalf of a group through a representing member. For eg., if residents of a street file a lawsuit against a nearby chemical factory, it is a class-action lawsuit.

A civil lawyer with experience in class action disputes must be chosen to fight against a giant group. He/she will help you aggregate the collective opinion, evidence, and witnesses to appear before the court if a negotiation with the opposition fails.

Complaint Against A City

It includes lawsuits filed against a ruling body or federal government. When the government fails to fulfill the interest and requirements of the people, citizens have all the right to file a complaint against the ruling government. Most of the time, the civil lawyer tries to settle it out of court.

Responsibilities of Civil Lawyer

Understanding the responsibilities and working areas of civil attorneys are necessary to conceptualize their need and significance in our society. They are closely related to citizens and safeguard legal rights.

A civil lawyer can be found everywhere; in a media house, corporate sector, NGOs, or any other private sector. They help people find better solutions and compensation for non-criminal legal disputes. Some of their crucial responsibilities include:

Informing & Advising

Training Witnesses and aggregating evidence

How a witness is presented in a courtroom is an integral part of the trial. A good civil lawyer helps clients to organize the witnesses to provide prompt and accurate statements without wavering from the focus point. The lawyer will guide the witnesses and take down depositions to present as testimony.

Pre-trial preparation is necessary to convince the court during the trial. As a final preparation, the civil lawyer makes sure that all the vital discoveries and witnesses are ready to be presented in front of the court.

Co-parenting is a crucial factor that determines your child’s happiness. Every child wants to feel the care of their parents while they are growing up. They need a complete family filled with joy and love. It is the birthright they hold. Parents have the responsibility to take care of the emotional and physical well-being of the child.

But relationship issues have become a common ordeal in today’s world. Co-parenting after divorce becomes troublesome in most cases. Make sure your relationship issues do not affect your child’s happiness. Mostly, children will be at the receiving end. It will adversely affect their emotional health and make them insecure.

Divorce is a phase in life. If you cannot live together as partners, you can separate and lead a happy life. But never let your child feel abandoned and deprived. Co-parenting after divorce is not a difficult task. Proper guidance from your Knoxville divorce lawyers on co-parenting rights will help you raise your child even after divorce.

Some Crucial Guidelines for Co-Parenting

Parenting seems to be normal. But there are so many intricate things you need to take care of especially if you are divorced and co-parenting. Balancing your issues and dealing with your child may seem to be difficult. But proper guidance and co-operation from the ex-partner will make things easy and smooth. Here are some basic guidelines for parents who are divorced and thinking of co-parenting.

Maintain a cordial relationship with your co-parent

Respecting each other’s decisions is the first and foremost thing you must learn while co-parenting. Mutual respect helps the child to imbibe good values. Discuss and plan your child’s future together. Never take any decision alone that results in an argument. Slight negligence and lack of communication in co-parenting is a violation of parenting rights. Your anxiety, tensions, and issues with co-parent should never affect your children.

Never Make Your Child A Messenger

Mostly, the child becomes a messenger in co-parenting. The communication gap between parents always puts the child in the middle. It gives the child pressure and leads him to extreme tension and depression. So, always keep aside your relationship issues at bay when it comes to your child. Why should your child bear the brunt of your relationship issues? So, keep your child away from all these issues.

Our expert divorce lawyers recommend maintaining effective communication with your ex-partner. You keep a shared calendar that will help you organize things. Never drag your personal issues while discussing your child’s future, and never question each other on their personal life after separation. Show your child that you both are working together to make his/her life trouble-free.

Never Blame ex-partner in front of Your Children

Whatever be the issues, never blame or talk bad about the other parent in front of the children. Keep your child away from such discussions and don’t ask him/her to take sides or spy on the other. Children will get to know things better once they grow up, never try to inject wrong feelings out of emotion. Let your child enjoy the love and affection of parents during the growing age.

Create a Parenting Plan

Sit down and create a parenting plan. Clarify everything prior to avoiding further arguments. Decide how to divide responsibilities. It should include everything like how to celebrate birthdays and holidays, how to spend time with the child. Make sure you revise the plan when the child grows by focusing on their growing requirements.

If parents belong to different ethnic groups, cultures, or religions, never go for an individual decision. Decide with your ex-partner and if possible, let the child imbibe good values from both cultures.

Read here about what to know when you want to modify the parenting plan.

Your Child Should be Given Priority Over Everything

Whatever decision you take, make sure that your child is comfortable. Don’t push your strategies or plans on the child. During co-parenting, parents always forget about the interests of children and make plans that are easy for their life. Every plan and decision should be taken by keeping the child’s interest at the forefront.

Also, one of the mistakes every parent commits in co-parenting is setting up rules. Keeping a calendar or dividing responsibilities work to avoid confusion and missing important days. But don’t thrust it upon each other as a rule. Parenting is not a rule, neither is it a mechanical process. If you don’t showcase your love through it, your child will never experience the love and warmth.

Never Make Transition and Visits Burdensome

Never make your child feel sick of frequent transitions. Encourage your child to spend time with co-parents, but frequent transitions sometimes make things mechanical. Ask your child’s desire, where he/she likes to spend time and feel attached. You don’t need to take a transition as a rule or obligation. Understand what your child needs and act accordingly.

What to do If Your ex-partner is not Cooperative?

Co-operation is a crucial part of co-parenting. If your co-parent disagrees to co-operate, you can find other professional assistance or legal support from divorce lawyers to maturely deal with things rather than indulging in any arguments in front of the child. An efficient divorce lawyer will help solve the issues through law and order.

On the other hand, if the situation is really bad with the other parent, then you can opt for parallel parenting, where the interaction between your ex-partner will be less. If nothing works between you both, it is better to consult a divorce attorney to move forward through court procedures.

Undergoing a divorce is a terrible phase. During this emotional turmoil, the last thing anyone needs is added trouble. However, it is quite unfortunate to see many individuals falling into deep financial troubles during the divorce proceedings.

Remember this financial trouble does not end with a huge paycheck being signed. But, it spells trouble to their life, children, and future.

So, being financially sound and astute during the divorce process can help you avoid a financial fallout.

The following are specific strategies laid down by Knoxville divorce attorneys to protect your finances:

Learn how much money you have

Before anything, you should know how much money you have. From in-hand cash to saving bank balance, you should know every penny you own. This includes your 401(K), IRA, any other savings or investment account.

Avoiding this step runs the risk of you unknowingly hiding money. Whilst this may be a genuine mistake, you shall lose credibility during the divorce process. And if you have multiple avenues of income, hire a Knoxville divorce attorney or a forensic accountant. They are professionals and shall work with your best interests in mind.

Get the valuables and other assets valued

Disclosure of all financial investments and valuables is great during a divorce. This helps both the parties know their assets and owings. By getting these valuables and assets valued, you can also gauge your cash flow. This is vital when you are planning the future of yours and your children.

The clarity in the ownership of assets and valuables can save a lot of unnecessary drama in the courtroom. By understanding each other’s entitlement, logic shall win against emotions.

Separate the bank accounts

One of the first steps you need to do is to open a separate bank account. Then, inform your spouse before transferring half of your joint account funds to the newer one.

This shall help you in tracking your money whilst also building an emergency fund. Consult with a few Knoxville divorce lawyers and have a fair estimate of the attorney fees. Only when you have sufficient funds for the fees and at least three months, file for a divorce.

Divorce proceedings are lengthy, so have some liquid assets to bank on. Also, get all the financial statements on which you have signed from the bank. They will further your credibility during the divorce process

Split debts and monitor your credit reports

Having joint credit while filing a divorce is a bad move, yet, committed by many. Pay all the joint credit and close the accounts as soon as possible. If not, there are chances of your spouse’s action affecting your credit score.

Remember creditors or banks do not care about your divorce. You are still liable to them, so split the debts and pay them. Attorneys in Knoxville Tn stress the importance of moving into divorce proceedings without debt.

Also, grab a copy of your credit report and scrutinize it with a fine-toothed comb. There might be scenarios where you are liable to a creditor without your knowledge. With a Knoxville divorce attorney to help, talk with the creditors and get your name cleared off the accounts.

Future-proof the tax game

Not all assets are taxed and if they are, chances are there for unequal taxation. While splitting assets, know the tax burden on each of them to ensure a fair split.

For example, A spouse receives 100,000 $ in Roth IRA and the other receives 100,000 $ in a checking account.

The value of the assets may be the same but after taxation, the latter shall have to cough up a substantial amount in taxes.

The concept of alimony is thrown around casually during the time of divorce. But, understand that it is a taxable income. Any mention of alimony in the final divorce decree can see money flowing to Uncle Sam.

From assets to the language used in the agreement, you should ensure there is an equal split post-taxes. This is one of the important details to know before moving into a divorce trial.

Hire a divorce attorney

All the aforesaid steps are crucial to secure your finances during the divorce process. While each step looks simple and DIY-like, it is not. With the number of emotions gushing you, these steps are irksome and shall exhaust you.

This might affect you in multiple ways like losing a crucial negotiation, settling for less, or even concealing an asset. None of these are in your favor and shall only deter your financial condition.

If there is one solution to all these, it is to hire a Knoxville divorce attorney. He/she comes with years of experience in negotiation and protecting one’s interests during divorce. They shall help you from filing paperwork to negotiating the splitting of assets.

No matter how well-informed and logical a party to the divorce is, he/she can never compensate for a professional attorney.

Conclusion:

Always remember the divorce process is a life-altering change. If it goes downhill at any point, recouping can be a struggle. Hence, invest in a quality divorce attorney and secure your financial position.

Workplace injuries are a critical threat that ruins the mental and physical balance of employees and their families. Depending upon the intensity of the non-fatal accidents, it can be a short-term accident or it can make you suffer for the whole life triggering your productivity.

Employees are eligible for compensation if they come across workplace injuries. You have put your life at risk to safeguard your workplace and make the work productive. Hence, it is the responsibility of your employer to provide you with compensation. And you should claim your rights by hiring a reputed and experienced attorney if your employer denies providing you compensation. A little bit of knowledge about workers’ compensation law will help you understand basic rights.

Choosing a professional lawyer is crucial to put forth your necessities to your employer. There are a plethora of experienced attorneys in Knoxville Tn. But choosing a workers compensation attorney should be done by looking into their experience in solving workplace injury-related cases.

Here are some tips for hiring the best attorney who can help you get compensation for a workplace injury.

Do a Research on your Case

Before you start searching for a Workers’ compensation lawyer, do a little research on your case to make sure that you are eligible for compensation. There are some crucial procedures you want to do before you choose a Workers’ compensation lawyer.

Reporting the injury within 30 days is a primary requisite. And figure out your company’s accident regulation schemes and insurance modalities to close all the foolproofing of your rights. Choose all available evidence-based information to make sure that your case is close to winning. It helps you speed up the procedures.

Make use of your Network

Ask your friends, relatives, or close acquaintance if any of them have a connection with an attorney. Or else, if you know someone related to a law firm, then you can ask for a reference to find an experienced attorney. You can make use of social media and other online networks also to search for attorneys near you.

Searching on the internet with the keyword ‘workers compensation lawyer near me’ will help you shortlist the best workplace compensation attorneys in Knoxville TN.

Start a Background Check

Checking on the internet and asking for a reference may help you shortlist some top-sought names. But your research should not end here. You need to dig more into their experience and track record. Analyze their competency in dealing with similar cases to ensure that they will be successful in helping you to claim your right.

Try to figure out whether the attorney you have chosen specializes in practicing Workers’ compensation. Even after having years of experience, some attorneys may not be successful enough to provide you with timely guidance. Hence, enquire in the respective jurisdiction to know about his/her awards, recognition, and settlements.

Checking the location or geographical proximity will make things better. Always try to choose someone near to you. This will help to ensure their availability whenever you need it.

Schedule a Meeting

You must have cut short the list by choosing the best 2-3 best attorneys in the town. Now it is the time to know them directly. Schedule a meeting with them to confirm whatever information you have collected about them is correct and certified.

Discuss with all the selected attorneys about your case for clarity. By now, you might be able to know who can provide you with the best guidance. A deep personal conversation with the attorney is inevitable to measure their potential and seriousness in dealing with your case.

This is also the time to analyze the engagement and personal attention the attorney provides you. If they are not friendly and open to you, things will not go smooth. You need an attorney who listens to you and provides a solution. Effective communication and interaction are criteria to look into while choosing an attorney.

Figure Out the Payment Model Beforehand

Before fixing the attorney, read their payment mandate to avoid any further confusion and dispute. Clarify the payment modalities and get a printed copy of the payment regulations.

Compare the pay scale with other attorneys you have shortlisted to confirm that you are not making any over expense. Have clarity on what you are paying and where you are being billed.

Write the Contract

When it comes to the final step, frame a contract to step into the next crucial phase. Once you fix the attorney, sign a contract that explains the working procedure, payment, and all the vital information you have decided through word of mouth.

A paper document will help to avoid any dispute in the future with your lawyer. Hence, it is mandatory to frame a contract that focuses on finding a better solution for your case.

Dealing with insurance firms can be a stressful and overwhelming process. Insurance matters often tend to get off-hand and become messy. People find it confusing and challenging to understand the complex terms and policies of insurance companies. It is especially true for someone who is a newbie to the insurance world; the probability that you would jumble up everything in your head and fail to understand the technicalities is high. It is enough reason to make you lose your insurance claim or lawsuit before it reaches its final hearing.

So now that you have a clear picture, do you want to take the unwanted stress? Call a trusted insurance defense attorney in Knoxville TN, to help you receive what you deserve. They are legal professionals who handle all insurance matters on your behalf, streamlining the entire process.

We give you a few reasons to hire a trustworthy insurance defense attorney in Knoxville TN:

1) Professional Guidance

As mentioned earlier, hiring an insurance attorney means that you have someone to give advice related to any insurance matters. For instance, you are in doubt if you should purchase a certain policy, your insurance lawyer is your go-to guy.

Sometimes insurance companies tend to pay poorly. In such a situation, the attorney can work one-to-one with the insurance company from your side to ensure that you get the desired amount. If this does not work and there is a battle between you and the insurance company, your lawyer will represent you in the lawsuit. Insurance litigation can be an overwhelming process to handle without the expertise of an insurance defense attorney by your side. You will be safe from any worries in claiming an insurance lawsuit as the professional help will ensure that you get the most out of your claim.

2) Denial to give claim

In many instances, an insurance company may deny your claim without giving you a valid reason or explanation. Imagine your condition in such a situation. You will have to go through so much stress. The insurance company has to provide a valid reason for denying the claim if you have filed a unique insurance claim. In addition to causing you stress, they are violating the law. They have to act in good faith and not assume that you are trying to pull a stunt to make money on your claim. They must assume your priority when you are filing a claim to cover the costs of your issue.

If the customers pay their bills on time, there is no reason why the insurance company should withhold their claim. In fact, the company should process the payment as quickly and efficiently as possible for a customer in good standing.

Many people feel powerless against the response issued by the insurance firm. There is no point in accepting the response when you know you are right. You will need the help of an insurance defense lawyer in such a situation. They have the expertise to review your claim and assess the scenario.

They can also help with the procedures you need to follow to facilitate the process. If they can find the loopholes, proving that the firm is violating the law, they will resolve the dispute and get you the money you deserve. With the knowledge and experience, they can maximize your chance of winning the lawsuit by turning the tables in your favor. They may sometimes even provide optional methods to resolve the dispute.

3) Assistance with documents

There is no doubt that insurance documents can tend to be confusing and difficult to understand. Who would be able to read in between the lines for you? Your insurance defense attorney! You may be worried about the extra expense you may have to incur in hiring a lawyer. But, trust us, it’s worth every penny. It even means you have free consultation whenever you need advice for your insurance problems. The advice may be related to your previous claims or even choosing a new insurance firm. A professional knows best; your lawyer will guide you through all the ups and downs of each clause, explaining every detail of the policy you are keen to invest.

These guys have the required analytical insights to review the documentation and find out any hidden gaps. Having a person familiar with the insurance laws can be a blessing in disguise; it can help save your precious time and save you from any frustration arising in the process.

4) Payment Delays

Let us consider this scenario: If you have a big fat hole in your home roof, can you keep waiting for the insurance company to clear your dues? You need the claim to be approved instantly to fix the problem.

When a client signs for a policy, the terms regarding the period during which the claim should be approved are agreed upon by both the parties. If there is no valid ground for delaying the payment, they are liable to provide a valid explanation. If they fail to do so, you can drag them to answer you in court.

Every state government sets different rules regarding the specific time frame that the insurance companies must adhere to for resolving claims. If the insurance company is slack in abiding by these rules, your attorney can step in to determine the cause of the delay.

If any documents or information is missing, the company must inform at the time of submitting the claim. During the processing period, they need to keep you informed about the status. The reason why insurance companies delay payments is that they might expect that you’ll get frustrated and give up on the claim.

With the assistance of insurance defense lawyers, there is no chance of such a situation arising. They would ensure that no such issue goes unaddressed.

5) Sudden Termination

Has this ever happened to you? You file an insurance claim, and your policy is unexpectedly terminated? If yes, don’t spare a single moment to contact your trusted legal advisor. It is a red flag, alerting you of false play. If there is any delay in resolving the issue, you may end up paying from your pocket.

The insurance company cannot terminate your policy unexpectedly, without providing a valid reason. If they do so, they are violating the law and deceiving you. It is unethical on the part of the company to terminate your policy without prior warning or explanation.

With the help of your insurance attorney, you can handle such complex situations with ease. They will contact the company and determine the cause of the unexpected termination. Their intervention will help to sort the issue and get you what you deserve.

6) When you have to deal with insurance company’s lawyer

There may be a situation when the insurance company may send their lawyer. Before you speak with their attorney, contact your insurance lawyer earlier. Don’t speak to their lawyer directly, without your lawyer present by your side.

If the insurance company is planning to file a suit against you, they’ll make you speak on the record. Whatever you say can be used against you in a court of law. The insurance company is least concerned about you; they have their best interest in their mind. If you answer their attorney’s questions alone, they may either invalidate your claim or will try to incriminate you.

Your insurance defense lawyer is your guy; he is concerned about your well-being. They can tutor you on what to say in front of the insurance company’s attorney.

How do you perceive a divorce?

Unhealthy and at times, toxic environment with constant arguments. A lengthy legal procedure with tons of paperwork. Disagreements and rebuttals leading to seeing who the child picks as his/her custodian.

What if I claimed that this perception is often false? The aforesaid perception is common, yet majorly false. And much like ice cream, divorces have alternatives too.

Before we delve into the alternatives of divorce, understand that for the success of each, communication and compromise are imperative.

So let us see in detail What are the different alternatives of getting a divorce without enduring the emotional trial:

Do it yourself (DIY) divorce

Like all those DIY trick shots and recipes, divorce can be done by yourself i.e you and your spouse. No lawyer fees, no family squabbles, no running to and from the courts. Sounds simple, right?

However, on the contrary, DIY divorce is not an ideal alternative by any means.

Despite your best efforts, you and your spouse shall never be able to replace professional legal help. Compensating for the absence of a family law attorney is not a plausible idea.

And even if you both try to work it out, whose interests are being served? A DIY divorce is prone to manipulations, further legal hassles, and more. In a bid to get this divorce over and done with, you might lose valuable leverage.

But, if the two of you are unequivocal on

Property division

Child parenting time

Legal decision-making authority

Spouse support

Child support

There exists a chance where DIY divorce might work. Even if these are fulfilled, suspicion of hidden assets, alimony settlement -is common hassles.

Also, apart from saving costs, DIY divorce does not benefit in any other major way. Given the general cost to benefits ratio, a Knoxville divorce attorney is your best way out.

Mediation

In this case, you and your spouse rest your case and its proceedings in the hands of a mediator. He/she may be a Knoxville divorce attorney or just another acquaintance, it doesn’t matter. He/she must be thorough with the intricacies of family law and neutral. A bias of any kind can derail the efficacy of opting for mediation.

The mediator does not make decisions nor advises you (or your spouse) on a personal level. All he/she does is facilitate a peace agreement between the two parties.

Mediation works well when the parties are looking for an amicable solution. Only if you and your spouse are reasonable and civil, mediation shall work. Name-calling, blaming are all common sights during a divorce proceeding. Rather than protecting anyone’s best interests, a mediator’s job is to promote healthy communication.

The advantages of mediation are obvious:

Less expensive

Less stressful

More control over the divorce

Expedites the divorce process

Considering these advantages, mediation may sound fool-proof. However, there are slight concerns given the informal and voluntary nature of the proceedings.

If negotiations fail, time and efforts are wasted in mediation. Likewise, a failed negotiation may also exhibit negative behavior. Since the financial data are voluntarily disclosed, the unearthing of hidden assets may not be possible.

The mediator is the vital cog in this process, yet he/she does not have any decision-making authority. Given his/her limitations, facilitating a sound agreement between the parties is a challenge. If done rightly, mediation is the most ideal alternative for divorce. If not, an already strained relationship just aggravates.

Collaborative

This is a settlement process where both the parties and their lawyers collaborate to resolve the conflict. This process is a confidential one that stems from the principle of continuing relationships and obligations.

When divorces mean the end of a bond, the relationships and obligations never die. With children involved, this grows in importance.

How does this process work?

First, both parties and their Knoxville divorce lawyers come forward to collaborate. The attorneys here advise you and your spouse towards reaching an amicable resolution. Also, the attorneys have the power to negotiate the specifics of the agreement, on behalf of their parties.

The distinctive part of collaborative divorce is the importance given to the adjacent happenings.

For example, to manage the financial needs of the parties, a professional may be called for. A professional divorce financial planner may be engaged to plan your future. Likewise, therapists or counselors are recruited to guide you through the child custody process.

On the flip side, collaborative divorce places enough power in the hands of the attorneys. Enough power for him/her to threaten the very fabric of the divorce. Usually, the party with a better lawyer can leverage the law and its loopholes to gain the upper hand. Whilst reaching an agreement is the final deal, the clauses and other specifics are up for negotiation. And during negotiation, leverage is the king.

Collaborative divorce is plausible but tough.

Litigation

The most common form of divorce is the litigation and wait, litigation does not mean in-court settlement. Though it may involve lawsuits at some stage, out-of-court settlements make the majority.

Litigation is also fondly pursued when only one party of the marriage seeks divorce. Having a Knoxville divorce attorney and an emotionally charged party on one side, most litigation cases are unilateral. Also, most of the litigation cases are the last resort of the couple who have failed in their mediation and collaborative efforts.

Litigation, by understanding, is time-extensive and a costly affair. However, since it is the only measure with absolute legal protection, it is the most popular method. Most Knoxville divorce lawyers shall expedite the process outside the court, culminating in a peaceful agreement.

With a reasonable negotiation, any family law attorney can facilitate an agreement without a lawsuit.

However, in extreme situations, an in-court settlement is imperative. This is more time-consuming given they are inclusive of every facet of divorce. Sticking points like child custody and alimony take a lot of time and effort.

With documentation and evidence considered ultimatum, bias due to leverage has fewer chances.
